This site is based on the premise that the Charter, although far from perfect, exists to embody and solidify common law principles which have served us well for generations. Without these principles, the freedoms we take for granted would not exist.
But freedom is always in jeopardy, whether from police and prosecutors or from bureaucrats and social engineers. Judicial activism can be a force to protect our natural liberties, or a force to serve the objectives of the State, against our common law rights.
CharterCases.com exists to provide critical analysis of various Charter decisions from a rational, classical liberal perspective, respecting the Rule of Law in our land, while recognizing that there is always room for improvement.
